These Terms of Service (“Terms”) form a binding agreement between you and Dialed (“Dialed,” “we,” “us”) for your use of the Dialed mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Dialed is a focus and accountability App that helps you commit to your goals through user-interface friction, reflection prompts, Live Activities, and other in-App tools. Dialed does not prevent or block other applications on your device. The App provides psychological and interface-level friction; it does not enforce restrictions at the operating-system level. You remain in control of your device at all times.
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App.
The App offers auto-renewing subscriptions. The following terms apply to all subscriptions:
All purchases are handled by Apple. Refund requests must be made through Apple at reportaproblem.apple.com and are governed by Apple’s refund policies. Dialed cannot directly issue refunds for App Store purchases.
You agree not to:
The core App works on your device without an account. Creating an account is optional and lets you use friends, leaderboards, and squads. You may sign in with your email address, Sign in with Apple, or Sign in with Google. You are responsible for the security of your account and for keeping your sign-in method safe.
When you use the community features, you choose a public @handle and may make your progress visible to friends or, if you opt in, on the global leaderboard. You agree not to impersonate others, harass or abuse other users, or choose a handle or display name that is offensive, misleading, or infringes anyone’s rights. We may remove content or handles, and suspend or terminate accounts, that violate these Terms.
You can permanently delete your account and all associated backend data at any time from within the App at Settings → Delete account. Your goals, sessions, and settings stored on your device are covered separately (“Wipe all data” in Settings, or deleting the App). See our Privacy Policy for details on what we collect, the service providers we use, and how deletion works.
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL CAUSE ANY PARTICULAR BEHAVIORAL OUTCOME.
Dialed is a productivity tool, not a medical device or treatment. It is not intended to diagnose, treat, cure, or prevent any condition. If you are struggling with focus, attention, or mental health, please consult a qualified professional.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIALED AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE APP. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIALED IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50.
You acknowledge that these Terms are between you and Dialed, not Apple, and that Apple is not responsible for the App or its content. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You may stop using the App at any time. We may suspend or terminate your access to the App if you breach these Terms or if we discontinue the App. Sections that by their nature should survive (including Disclaimers, Limitation of Liability, and Governing Law) will survive termination.
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Connecticut, and you consent to personal jurisdiction in those courts.
